Right of Withdrawal

Holdy is currently offered exclusively to Business Users , freelancers, self-employed individuals, agencies, and registered businesses using the Services for professional or business purposes. See Clause 5.2 of the Terms of Service.

The 14-day right of withdrawal under Directive 2011/83/EU (as amended by Directive 2023/2673), Articles 6:230g–6:230z of the Dutch Civil Code, and Regulation 29 et seq. of the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 applies only to Consumers entering into distance contracts for purposes outside their trade, business, profession, or craft.

Because no party to a contract on Holdy currently uses the Services as a Consumer, no statutory cooling-off period applies between Holdy and a User, or between a Buyer and a Seller transacting via Holdy.

What you can do instead

  • Before payment: a Seller can cancel an unfunded Deal at any time through the in-product cancellation option. A Buyer can simply choose not to pay.
  • After payment: Buyer and Seller can agree on a mutual refund (Clause 9.2 of the Terms). Either party initiates the request in-product; the counterparty has 48 hours to accept.
  • Rule-based outcomes: the deliverable acceptance / rejection engine (Clause 10) applies automatically , deals that are not covered, that miss their deadline, or that hit the cumulative two-rejection cap refund automatically.
  • Card-network rights: if you paid by card, your right to dispute the transaction with your card issuer is unaffected (Clause 11.8 of the Terms).

If we add a Consumer offering

If Holdy ever opens the Services to Consumers, this page will be replaced with a full statement of the cooling-off right, including:

  • A 14-day withdrawal period from the date the contract is concluded;
  • The express-consent and acknowledgment flow required to validly start performance during the cooling-off period (Article 16(a) and 16(m) Directive 2011/83/EU; Regulations 36 and 37 UK CCRs 2013), with a confirmation on a durable medium;
  • The model withdrawal form (Annex I, Part B Directive 2011/83/EU; Schedule 3 UK CCRs 2013);
  • A pro-rata refund mechanism for partially-performed services.

Until that announcement, this page exists for transparency and reachability; do not rely on it as a Consumer right.
